Last September our client was safely driving his motorcycle north on Georgia Highway 77 towards downtown Elberton, Georgia. The defendant was driving east on Lake Forest Drive in his full size pickup truck. As our client approached the intersection of Lake Forest Drive, the defendant failed to yield pursuant to O.C.G.A. §40-6-70 and drove through the stop sign and violently struck our client’s motorcycle with the front of his full-sized pickup truck. The defendant was issued a citation as he was clearly at fault. Emergency responders including Elberton Police and Elbert County EMS arrived on the accident scene shortly after the accident occurred. The force of the impact was so great that according to the EMS records our client was found was found 10-20 yards from his motorcycle.
Following the collision, Our client was transported to Piedmont Athens Regional Medical Center via ambulance by Elbert County EMS after being placed into a cervical collar. Our client had suffered a severe injury to his lower leg and the fractured bones were protruding through the skin. This is sometimes referred to as a compound fracture.
Our client was admitted to Trauma Service at Piedmont Athens Regional Hospital and initially diagnosed with the following injuries:
Our client underwent surgery to repair the horrific injuries to his lower leg. The surgical procedure included incision and drainage, intramedullary rod of left open tibia fracture, open reduction and internal fixation (ORIF) of proximal fibula fracture, and open treatment of proximal tibia/fibula dislocation. He was maintained on post-op antibiotics and lovenox.
Our client’s postoperative care was complicated when he developed ileus which required prolonged hospitalization. Our client was given a nasogastric tube or “NG” to help relieve the painful symptoms of ileus. The litany of pain medications and opiates were the cause of his ileus. Our client was finally discharged from the hospital after 11 days of care following his motorcycle wreck.
Jeremiah and Tash were able to settle this case for $685,000 prior to going to court. Negotiations with Selective Insurance and Geico Insurance resulted in a settlement over 4 times the cost of our client’s medical bills.
